By registering an account and using ETXPriceWar.com, you agree to the terms below.
Governing Law & Jurisdiction
These Terms and Conditions, and your use of ETXPriceWar.com, shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard to its conflict of law principles. You expressly agree that any legal action, suit, or proceeding arising out of or relating to these Terms, your use of the platform, or any auction transactions must be brought exclusively in the state or federal courts located in Panola County, Texas. You hereby irrevocably consent and submit to the personal jurisdiction and venue of such courts for the purpose of litigating any such action, and you waive any objection based on an inconvenient forum.
Dispute Resolution and Binding Arbitration
1. Informal Resolution First. Before filing any formal legal claim or arbitration demand, you and East Texas Price War agree to make a good-faith effort to resolve the dispute informally. You must send a written description of your dispute, along with any supporting documentation, to legal@etxpricewar.com. If we are unable to reach a resolution within thirty (30) days of receiving your notice, either party may then proceed to binding arbitration as outlined below.
2. Agreement to Binding Arbitration. You and East Texas Price War agree that any dispute, claim, or controversy arising out of or relating to these Terms, the use of ETXPriceWar.com, or any auction transactions that cannot be resolved through the informal process, shall be settled exclusively by binding, individual arbitration. This means you waive your right to a trial by jury and your right to sue in a court of law.
3. Arbitration Procedures. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place exclusively in Panola County, Texas, and shall be conducted in the English language. If the claim is for $10,000 or less, the party initiating the arbitration may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator or through a telephonic or video hearing.
4. Class Action Waiver. YOU AND EAST TEXAS PRICE WAR / ETXPRICEWAR.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a class or representative proceeding.
